These Terms of Service govern your access to and use of Only EV, including listings, dealer advertising, contact forms, landing pages, and related services.
1. Acceptance of these terms
These Terms of Service (“Terms”) apply to your access to and use of onlyev.com and any related pages, forms, content, features, and services operated by Only EV (“Only EV,” “we,” “us,” “our,” or the “Site”). By accessing or using the Site, you agree to be bound by these Terms.
2. What the Site does
The Site is an independent online marketplace and marketing platform focused on used EVs and related services. We may offer listing pages, dealer advertising, lead forms, cash-offer related forms, informational content, and software tools.
Unless we expressly state otherwise in writing, Only EV is not an OEM, is not affiliated with any specific manufacturer, and is not a party to any vehicle transaction between buyers and sellers. We are not acting as a dealer, broker, auctioneer, lender, insurer, escrow provider, shipping company, title company, or legal advisor.
3. Eligibility and account responsibility
You must be legally able to enter into a binding agreement to use the Site. If you submit information, create a listing, or otherwise use an account or protected feature, you are responsible for the accuracy of your information and for all activity occurring under your credentials or through your device.
4. Listings, dealer content, and submissions
If you upload, submit, publish, email, or otherwise provide text, photos, videos, descriptions, pricing, contact details, dealership data, or other materials to the Site (“Submissions”), you represent and warrant that:
- you have the right to provide the Submission and to allow us to use it in connection with the Site;
- the Submission is accurate to the best of your knowledge and not misleading or fraudulent;
- the Submission does not violate any law or infringe any third-party right; and
- you will promptly update or remove information that becomes materially inaccurate.
You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, format, and use your Submissions as needed to operate, market, and improve the Site and related services.
5. Transactions are between users and third parties
All negotiations, inspections, financing decisions, payments, shipping, registration, title transfers, warranties, taxes, and contracts relating to a vehicle remain solely between the relevant buyer, seller, dealer, or third party. You are responsible for independently verifying vehicle condition, ownership, title status, recalls, software status, pricing, and all other material facts before entering a transaction.
6. Fees, dealer plans, and communications
Certain Site features or dealer services may be offered for a fee. Any pricing, plan details, campaign scope, or service terms we provide may be updated from time to time. You agree to pay any charges you accept in connection with paid services.
By submitting an inquiry or form through the Site, you authorize us and any relevant seller, dealer, or service provider to contact you using the information you provide, subject to applicable law.
7. Prohibited conduct
You may not:
- use the Site for unlawful, fraudulent, deceptive, harassing, or abusive purposes;
- post false vehicle information, fake pricing, fake identities, or misleading dealership claims;
- interfere with the Site’s operation, security, analytics, or availability;
- copy or republish substantial portions of the Site without written permission; or
- use automated tools to scrape listings, contact information, or protected content.
8. Intellectual property
The Site, including its design, layout, branding, code, graphics, text, and compiled content, is owned by us or our licensors and protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
9. Third-party services and links
The Site may integrate with or link to third-party services, including social platforms, analytics providers, payment or marketing tools, map providers, and external marketplaces. We do not control those third parties and are not responsible for their services, policies, content, or availability.
10. Disclaimer of warranties
The Site and all content, listings, and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, and accuracy.
11. Limitation of liability
To the fullest extent permitted by law, Only EV, Adam Qureshi, and our affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, revenue, goodwill, or business opportunity arising out of or related to the Site.
To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Site or these Terms will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the applicable paid service in the twelve months before the claim arose.
12. Indemnification
You agree to defend, indemnify, and hold harmless Only EV, Adam Qureshi, and our affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your access to or use of the Site;
- your Submissions, listings, dealer materials, or inquiries;
- your violation of these Terms;
- your violation of any law or third-party right; or
- any dispute between you and a buyer, seller, dealer, platform, or other third party.
13. Suspension and termination
We may suspend, remove, refuse, or terminate access to any part of the Site, any Submission, or any paid or unpaid service, at any time and for any lawful reason, including suspected fraud, misuse, legal risk, technical issues, or violations of these Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute arising out of or relating to the Site or these Terms must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that jurisdiction and venue.
15. Changes and contact
