This Visitor Agreement governs casual browsing and informational use of the public portions of Only EV and related landing pages. By visiting or using the Site, you agree to this agreement.
1. Acceptance of this agreement
This Visitor Agreement applies to your access to the public portions of onlyev.com and related pages, content, forms, and materials made available by Only EV (the “Site,” “we,” “us,” or “our”). If you do not agree, do not use the Site.
2. Permitted use
You may use the Site for personal, informational, and business evaluation purposes, including browsing listings, learning about our services, reviewing dealer information, and contacting us through approved channels.
- review public content and listing information for legitimate shopping or business purposes;
- contact us or a seller/dealer through the Site in good faith; and
- print or save limited portions of the Site for your own internal, non-infringing use.
3. Restrictions on use
You agree not to misuse the Site. Without limitation, you may not:
- scrape, harvest, copy, mirror, or systematically extract Site content, listings, or contact details without our written permission;
- use bots, scripts, or automated tools that burden, disrupt, or interfere with the Site;
- attempt to bypass security, probe vulnerabilities, or reverse engineer the Site;
- submit false, misleading, infringing, unlawful, or fraudulent inquiries; or
- use the Site in violation of any law, regulation, or third-party right.
4. Third-party links and information
The Site may link to third-party websites, listings, platforms, payment tools, maps, social profiles, and other services. We do not control those third parties and are not responsible for their availability, content, policies, acts, or omissions. Any interaction with a third party is solely between you and that third party.
5. No warranties
The Site is provided on an “as is” and “as available” basis. We make no promises that the Site will be uninterrupted, error free, complete, current, secure, or suitable for your needs. Listing information, pricing, vehicle condition, availability, and related statements may change at any time and should always be independently verified.
6. Limitation of liability
To the fullest extent permitted by law, Only EV, Adam Qureshi, and our affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, use, or data arising out of or related to your use of the Site.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or relating to this agreement or your use of the Site will not exceed one hundred U.S. dollars (US $100).
7. Indemnification
You agree to defend, indemnify, and hold harmless Only EV, Adam Qureshi, and our affiliates, contractors, licensors, and service providers from and against any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Site;
- your violation of this Visitor Agreement;
- your violation of any law, regulation, or third-party right; or
- any dispute between you and another user, buyer, seller, dealer, platform, or third party.
8. Governing law and venue
This Visitor Agreement is governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or relating to this agreement or the Site must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that venue and jurisdiction.
9. Changes and contact
We may update this Visitor Agreement from time to time by posting a revised version on the Site. Your continued use of the Site after an update means you accept the revised agreement. Questions may be sent to contact@onlyev.com.
